MDForLives is a platform designed to engage healthcare professionals, allied healthcare professionals, and patients in meaningful market research studies and surveys. The platform is owned and operated by Borderless Access Private Limited, an award-winning insights and research solutions company recognized for its digital-first products and agile research capabilities (hereinafter referred to as “Borderless Access”). Through a strong focus on data-driven decision-making, MDForLives enables organizations to access valuable insights by connecting them with relevant participant communities.
Participants can access MDForLives through its official website, www.mdforlives.com, as well as the MDForLives mobile application, ensuring convenient and seamless participation across devices.
To maintain a transparent, secure, and reliable experience for all users, these Terms & Conditions govern access to and participation in the MDForLives website and mobile application and outline the rights, responsibilities, and expectations applicable to all users of the platform.
Data collection, processing, retention, sub-processor disclosures, data principal rights (including access, correction, erasure, and grievance redressal), and breach notification are governed by the MDForLives Privacy Policy. For participants in Canada, the Privacy Policy complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, Quebec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25). In case of any conflict between these Terms and the Privacy Policy on data-related matters, the Privacy Policy shall prevail.
The MDForLives App, developed and operated by Borderless Access, is designed to facilitate seamless participation in healthcare research studies and surveys.
During the registration process, users must acknowledge and accept these terms by selecting the consent checkbox.
Violation of any conditions may result in the suspension or termination of membership.
IF YOU DISAGREE WITH ANY OF THE TERMS & CONDITIONS OR FUTURE MODIFICATIONS, YOUR ONLY COURSE OF ACTION IS TO DISCONTINUE PARTICIPATION IN MDFORLIVES AND TERMINATE YOUR MEMBERSHIP IMMEDIATELY.
Borderless Access reserves the right to modify or discontinue the MDForLives program, with or without prior notice.
1. Use of the Website and Contractual Agreement:
1.1 Definition of Terms
In this Agreement, "you" and "the member" refer to the individual completing the registration process to become a participant in the MDForLives program.
Platform refers collectively to the MDForLives website accessible at www.mdforlives.com and the MDForLives mobile application available on iOS and Android, including any future versions or updates thereof.
1.2 Compliance
You agree to use the MDForLives website and application strictly in accordance with this Agreement and all applicable laws and regulations.
1.3 Legally Binding Agreement
Your participation in MDForLives surveys and research activities, confirmed by the submission of the required information, constitutes a legally binding agreement governed by these Terms & Conditions and any additional policies established by Borderless Access.
1.4 Membership Activation
Upon completing the registration questionnaire, you will be deemed a member of the MDForLives program.
1.5 Nature of the Agreement
This Agreement constitutes a contract for service provision and does not establish a legal partnership, agency relationship, or employer-employee affiliation between you and Borderless Access.
2. Panel Registration:
To access the MDForLives platform and participate in surveys, you are required to register and become a panel member. By registering, you consent to receiving communications from MDForLives related to the platform and its services.
During registration, you must provide accurate, current, and complete details, including:
· Email ID
· Date of Birth
· Gender
· Speciality
For Healthcare Professionals (HCPs): Valid Medical License Number and an official Medical License Document as proof of qualification.
For Allied Healthcare Professionals (AHPs): We accept a valid Medical License or LinkedIn Profile URL as proof of qualification.
For Patients: A valid prescription issued by a registered healthcare professional as proof of eligibility.
For participants registering from Canada, your consent to receive communications from MDForLives constitutes express consent under Canada's Anti-Spam Legislation (CASL). You may withdraw consent to commercial electronic messages at any time by using the unsubscribe mechanism provided in each communication, without affecting your panel membership unless such communications are necessary for platform operation.
Once submitted, your details will undergo a verification process. If the information provided is inaccurate, incomplete, or unverifiable, MDForLives reserves the right to reject your registration request.
Panel membership is strictly personal and may only be used by the registered individual. You are prohibited from:
i. Registering with a pseudonym or impersonating another individual.
ii. Using a name or credentials belonging to another person without authorization.
iii. Providing false or misleading information of any kind, including regarding medical qualifications or prescriptions (see Fraud Prevention Measures below)
MDForLives reserves the right to refuse or cancel panel membership at its sole discretion. You are responsible for maintaining the confidentiality of your login credentials, and any activity conducted through your account will be considered authorized by you. If you suspect unauthorized access to your account, you must notify MDForLives immediately.
All personal data shared during registration will be processed in accordance with our Privacy Policy.
3. Eligibility Criteria:
To ensure a high-quality and compliant research community, individuals seeking membership in MDForLives must meet the following eligibility requirements:
Minimum Age Requirement: Participants must be at least 18 years old at the time of registration. This age criterion ensures that all members have the legal capacity to provide informed consent and engage in market research activities in accordance with applicable laws and regulations.
Residency Requirement: Membership is restricted to legal residents of specific countries where MDForLives operates. Eligible participants must reside in one of the following countries:
· United States of America (USA)
· United Kingdom (UK)
· Canada
· Germany
· France
· Italy
· India
This geographic limitation ensures compliance with regional legal requirements and facilitates accurate research insights tailored to each market.
Individual Participation Only: MDForLives membership is strictly limited to individuals and is not available to corporations, businesses, or any other non-individual entities. The platform is designed for personal participation, ensuring that healthcare professionals and qualified individuals contribute firsthand insights to market research studies.
Adhering to these eligibility requirements is essential for maintaining the integrity and credibility of the MDForLives community. Failure to meet or maintain these criteria may result in the denial or termination of membership.
Registration as a panel member does not guarantee eligibility for, invitation to, or participation in any specific survey, study, discussion, or research activity.
MDForLives does not guarantee any minimum number of survey invitations, participation opportunities, incentive amounts, or earnings.
Participants registering from Canada acknowledge that provincial privacy laws, including Quebec's Law 25, may apply in addition to federal PIPEDA requirements. Participation by Quebec residents is subject to the additional data protection provisions set out in the Privacy Policy.
4. Payments:
Borderless Access establishes the structure of honoraria and incentive payments for survey participation, including the nature of rewards, the amount payable, and the method of disbursement. The incentive amount varies based on multiple factors, such as the length of the survey, complexity of the study, target audience, and the type of market research conducted. Additionally, all payments are subject to compliance with applicable local regulations governing incentives for survey participation.
Once a study or market research survey is completed, honorarium payments go through a verification and processing phase to ensure data integrity and compliance with research standards. Payments are typically disbursed within 6-7 weeks from the date the survey officially closes. This timeframe allows for:
· Quality checks to assess the validity and completeness of responses.
· Verification processes to ensure compliance with survey guidelines.
· Regulatory adherence based on applicable local requirements.
Important Note: If a participant's responses do not meet the required quality criteria, including but not limited to inconsistent, incomplete, or fraudulent submissions, the honorarium will not be paid. MDForLives reserves the right to determine response validity and enforce quality control measures.
All honoraria and incentive payments must be redeemed within 12 months from the date of crediting. Failure to claim the amount within this period will result in automatic expiration, irrespective of account activity.
Participation in surveys is subject to study-specific eligibility and screening requirements. Participants may be screened out, disqualified, or deemed ineligible at any stage of a survey if they do not meet the applicable criteria or quality standards.
MDForLives reserves the right, in its sole but reasonable discretion, to withhold, delay, reverse, cancel, or deny incentives, honoraria, or rewards where responses are identified as fraudulent, duplicate, automated, inconsistent, inattentive, misleading, fabricated, excessively rapid, incomplete, or otherwise non-compliant with research quality standards or these Terms & Conditions.
MDForLives may conduct verification, fraud detection, quality assurance, and validation reviews prior to processing payments.
Unless expressly stated otherwise, screened-out or disqualified participants shall not be entitled to receive incentives, honoraria, or compensation for incomplete participation.
Borderless Access will comply with applicable tax withholding obligations where legally required under the laws of the participant's jurisdiction. For Canada-based participants, payments may be subject to applicable Canadian income tax reporting obligations, and participants are responsible for declaring honoraria as income under the Income Tax Act (Canada). For all other tax obligations — including reporting and compliance with duties, levies, or governmental charges — participants are solely responsible under the laws of their respective jurisdictions.
5. Fraud Prevention Measures:
To ensure the integrity of the MDForLives platform, the following activities are strictly prohibited and may result in immediate termination of membership:
• Registering multiple times under different names or email addresses.
• Attempting to complete the same survey multiple times.
• Providing false, misleading, or fabricated information during registration or survey participation.
• Utilizing bots, scripts, or automated methods to participate in surveys.
• Engaging in any fraudulent activity that manipulates or falsifies survey responses.
Borderless Access reserves the right to investigate and take necessary actions, including withholding payments and terminating accounts, if fraudulent activity is suspected.
Fraud Detection and Platform Integrity: MDForLives may utilize automated fraud prevention tools, digital fingerprinting technologies, device identification systems, behavioral analytics, IP monitoring, and related verification measures to detect duplicate accounts, fraudulent participation, automated responses, or suspicious activity.
By using the platform, participants consent to such monitoring and verification activities for the purpose of maintaining platform integrity, research quality, and security.
6. Termination:
Borderless Access reserves the right to terminate this Agreement and revoke membership in MDForLives under the following conditions:
• Immediate Termination for Breach of Agreement: Any violation of the Terms & Conditions, including fraudulent activity, misrepresentation, or any action deemed harmful to the integrity of the platform, may result in immediate termination of membership without prior notice.
• Termination with Prior Notice: MDForLives may terminate a member's account for reasons other than a direct breach, providing a 30-day advance notice via email. During this period, members will have the opportunity to address any concerns or withdraw any remaining honoraria before account closure.
• Termination Due to Inactivity: Membership may be revoked if a participant remains inactive for 12 consecutive months, meaning they have not participated in any surveys or research activities within that period. Prior to termination, members may be notified regarding their inactivity.
• Member-Initiated Termination: Members have the right to terminate their participation at any time by unsubscribing from MDForLives. Once a termination request is received, account deactivation will be processed within seven business days. Upon termination, access to the platform, including any accumulated incentives that have not been redeemed, may be forfeited.
7. Intellectual Property Rights:
All intellectual property rights, including copyrights, trademarks, database rights, survey content, questionnaires, research materials, software, applications, graphics, logos, and platform content available through MDForLives shall remain the exclusive property of Borderless Access and/or its licensors, clients, or affiliates.
By participating in surveys or research activities, participants assign and transfer to Borderless Access all rights, title, and interest, including intellectual property rights, in and to survey responses, comments, feedback, suggestions, ideas, and research submissions provided through the platform, subject to applicable privacy protections.
Participants shall not copy, reproduce, modify, distribute, publish, sell, commercially exploit, or create derivative works from any platform content without prior written consent.
8. Limitation of Liability:
To the fullest extent permitted under applicable law, MDForLives, Borderless Access, its affiliates, officers, employees, agents, contractors, licensors, and research partners shall not be liable for any indirect, incidental, consequential, punitive, exemplary, special, or economic damages, including loss of profits, data, goodwill, incentives, business opportunities, or reputation arising out of or related to:
i. use of or inability to use the platform;
ii. delays, interruptions, errors, bugs, system failures, or service outages;
iii. unauthorized access to accounts or data;
iv. reliance on platform content or survey materials;
v. suspension or termination of membership; or
vi. acts or omissions of third parties.
MDForLives does not guarantee uninterrupted access, error-free functionality, continuous availability, or the accuracy, completeness, or reliability of any information available on the platform.
To the maximum extent permitted by law, the aggregate liability of Borderless Access arising out of or relating to the platform or these Terms & Conditions shall not exceed the total incentives or honoraria paid to the participant during the twelve (12) months immediately preceding the event giving rise to the claim.
9. Amendments to the Terms & Conditions:
MDForLives reserves the right to update, modify, or amend these Terms & Conditions at its discretion. Changes may be made to reflect updates in policies, regulatory requirements, technological advancements, or service enhancements.
Whenever modifications occur, MDForLives will make reasonable efforts to notify users, which may include updates via email, in-app notifications, or announcements on the website. However, it remains the user's responsibility to review the latest version of the Terms & Conditions periodically.
Continued use of the MDForLives website, mobile application, or participation in surveys after any updates take effect will be considered acceptance of the revised terms. If a user does not agree with the changes, they may discontinue their participation and request account termination.
10. Grievance Redressal:
For data protection-related grievances or complaints regarding the Platform, participants may contact our Grievance Officer whose details are set out in the Privacy Policy. MDForLives will acknowledge grievances within 48 hours and endeavour to resolve them within 30 days of receipt.
Participants in Canada may refer unresolved complaints to the Office of the Privacy Commissioner of Canada (OPC) at www.priv.gc.ca. Quebec residents may additionally contact the Commission d'accès à l'information (CAI) at www.cai.quebec.ca.
11. Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, India, subject to the dispute resolution process below.
In the event of any dispute arising out of or in connection with these Terms & Conditions, the parties shall first attempt to resolve the matter through good faith negotiation within 30 days of written notice of the dispute. If unresolved, the dispute shall be referred to mediation under applicable rules before either party may initiate court proceedings. Nothing in this clause prevents either party from seeking urgent injunctive relief.
12. Force Majeure:
Borderless Access shall not be liable for any delay, interruption, failure, or inability to perform its obligations arising from events beyond its reasonable control, including but not limited to natural disasters, pandemics, acts of government, cyberattacks, internet failures, power outages, labor disputes, war, terrorism, technical failures, telecommunications disruptions, or force majeure events.
13. Severability:
If any provision of these Terms & Conditions is determined to be unlawful, invalid, or unenforceable by a court or competent authority, such provision shall be severed and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
14. Medical Disclaimer:
MDForLives and Borderless Access do not provide medical advice, diagnosis, treatment recommendations, prescriptions, healthcare services, or clinical opinions.
Any information, content, survey materials, articles, discussions, or research insights available through the platform are provided solely for informational and research purposes and must not be relied upon for medical decision-making, diagnosis, treatment, emergency care, or patient management.
Participants should always seek advice from qualified healthcare professionals regarding medical conditions or treatment decisions.
MDForLives shall not be liable for any reliance placed upon platform content for healthcare or medical purposes.
15. Indemnification:
You agree to indemnify, defend, and hold harmless Borderless Access, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your breach of these Terms & Conditions; (b) your provision of false, misleading, or fraudulent information during registration or survey participation; (c) your violation of any applicable law or third-party rights; or (d) any misuse of your account or membership credentials.
